My neck pillow is always with me when I travel. This might look trivial, but it is a game-changer during long trips. I learned that the hard way a few years ago when I had an extremely grueling journey.

I did not expect what happened next. In one of the corners, all wrapped up around my neck like some scarf, I fell fast asleep and was out cold as if nothing had happened.

This short nap was just enough for me to get energized for the other parts of the trip. When I eventually got on board for my flight, all thanks to this little pillow, I was refreshed and good to go.

Ever since then, I have never embarked on any journey without it. It doesn’t matter whether I am traveling by plane, train, or even waiting; if there is one thing that makes me rest comfortably wherever I’m at, it’s having a neck pillow.

Recent visitors to Mexico are coming back with more than just sunburns and serapes. They’re also coming back with tales of being held up at Mexico customs by officers intent on enforcing rules that impose harsh taxes on visitors with more electronic devices than the government deems necessary.

News accounts are popping up about tourists facing hefty fines for bringing in too many laptops, iPads and similar devices. Some say they’ve been forced to pony up hundreds of dollars to get through customs on arrival.

The law states travellers face taxes of up to 19% of the deemed value of the device. But “deemed value” can be one thing to a visitor and something else entirely to a customs officer, and travel forum websites are filled with stories of people who feel they got hosed.

In a recent story at USA Today, it was reported that Florida-based travel advisor Tammy Levent brought her laptop and iPad through CUN and had to pay almost USD$200 in fines.

Levent is owner of Elite Travel Management Group and visits the Riviera Maya several times a year for work, often bringing new agents with her for training.

She told the publication that when she arrived at CUN for a recent trip, a border agent pulled out her laptop and an older iPad and told her “You can’t have both.” Levent said she’s always brought these devices with her before, and that it was never an issue.

In a story at Riviera Maya News, David Ortiz Mena, President of the Tulum Hotel Association, said it’s “incredible” that customs officers are hitting tourists with fines at a time when local authorities are trying to lure more visitors to the region.

“At the end of the day, you want tourism but you’re driving people away,” she said. “You have huge companies like pharmaceutical companies… (bringing groups in) and they’re coming with laptops and iPads.”

Forbes recently posted a story that says this is “happening to tourists everyday, especially at CUN, Mexico’s largest airport.”

A writer for Forbes said a friend arrived at CUN recently. A customs agent searched her bag and found an iPad and MacBook Pro, then demanded she pay 3,690 Mexican pesos (about USD$190 or CAD$255) in duty for the laptop “or kiss it goodbye.”

“This has actually been in effect for a very, very long time,” Michael Boguslavskiy, a travel agent for Caballeros Vacations who specializes in Cancun trips, told USA TODAY. “It was never strongly enforced but now they are enforcing it worse than they ever have before.”

One alleged victim on Reddit said he arrived at CUN with a camera and three lenses and was forced to pay USD$200 in taxes for two more lenses than he was allowed. And that was after negotiating the original fine to a smaller amount.

Some 35,000 people fly into CUN every day. If the government hit just one per cent of those visitors with a fine of USD$200 if would mean USD$25 million a year, and that’s just for one airport.

The Mexican government’s website has a long list of items that people can bring in without paying taxes, whether items or new or second-hand. For electronics, this is what the site says is allowed: Two cameras or camcorders and camera gear; three cellphones or other wireless devices; one GPS; one electronic organizer; one laptop, notebook, omnibook or other portable computing device; one portable copier or printer; one CD burner and one portable overhead projector and its accessories.

There are tons of other limits, including four fishing rods, two musical instruments and their accessories, ten DVD’s, 30 CD’s, one pair of binoculars, and five toys, including collectibles, one videogame console and five videogames (be careful if you have kids).

On top of everything else, the language is clearly outdated. Who even owns a CD burner? And who, other than snowbirds who drive to Mexico, would take 30 CD’s or ten DVD’s?

Mexican airport officials are cracking down on imports of consumer electronics, including visitors’ personal laptops and tablets, tourists to the country say. 

Reports in USA Today and Forbes detail a number of recent travel experiences where visitors arriving at Cancun International Airport have been confronted by customs agents over the number of personal electronic devices they are carrying.

More than one device could cost you 

Unbeknownst to many arrivals in the Land of the Sun, Mexico operates under regulations that limit the number of portable computing devices each person can bring in. The rules are intended to prevent people bringing in goods and selling them on the black market. Just one “portable computer” is permitted per foreign arrival, and a laptop and tablet count as two devices.

The penalty? Either allow your least preferred device to be seized by Mexican customs, or in line with the country’s General Rules for Foreign Trade, under Baggage and Passenger Allowance, pay a fee representing 19% of the object’s value, up to $4,000. And beware: that’s 19% of the value it is deemed to have by a Mexican customs operative.

Tammy Levant, a writer for Elite Travel who spoke to USA Today about her border experience said she felt the customs official had over-estimated the value of her “older generation iPad”, which generated a larger fine for her to pay.

“Driving people away”

The rules are not new, but the general consensus among commentators seems to be that they are being applied more assiduously than before, particularly for arrivals at Cancun International, the country’s busiest hub which handles 500 daily flights and more than 13 million passengers a year.

Levant, owner of Elite Travel Management Group, has regularly visited Cancun two or three times a year, often training groups of colleagues, and had never been pulled aside by customs before. She pointed to the large numbers of professional conferences held in Mexico and suggested applying the tax on multiple devices would soon start “driving people away.”

Outdated rule “hurts Mexico’s image”

Meanwhile, a Cancun specialist travel agent Michael Boguslavskiy, said the rule “has actually been in effect for a very, very long time.” It also applies to items such as DVDs and cameras and was, in his words, “a massively outdated list at this point but it’s still there.” 

But if Mexican stakeholders have their way, the rule might not be in force for much longer. Local news outlet Riviera Maya News spoke to the President of the Tulum Hotel Association, David Ortiz Mena, who acknowledged that remote working had generated a new kind of traveller who expects to be able to work across multiple devices.

“We will have to review this situation and the law to avoid this type of impact. There are already all kinds of comments on social media,” Ortiz Mena said. Saying the news coverage “hurts our image” he insisted, “If we want to be a tourist powerhouse, let us be consistent.”

It’s also not the only way Mexican customs can feel like smoke and mirrors to travelers, according to Boguslavskiy. Only two cameras are allowed tax-free, and technically, cigarettes exceeding 10 packs can be fined or confiscated. Since there’s a duty-free store right before customs, people stock up on cheap tobacco thinking “it’s safe,” only to have it seized shortly after purchasing, he said.

Upset with her Cancun Airport experience, Levent sent complaint letters to Mexican officials. In a return letter from the Cancun Customs Administration, Levent was told the luggage inspections are done at random.

Boguslavskiy sends the customs list to all his clients heading to Mexico and advises every traveler going abroad to “please be up to date with what the local rules of customs are.”

Cancun Airport Extortion? A Tourist’s Experience and the Potential Impact on Mexico’s Tourism

As a travel professional and owner of Elite Travel Management Group, with almost 30 years of experience bringing business to Mexico, I never anticipated that my most recent trip to Cancun in June 2024 would leave me questioning the future of tourism in this beautiful country. What began as a routine entry into Mexico turned into a distressing ordeal that left me feeling extorted, frustrated, and deeply concerned about the treatment of tourists.

Upon arriving at Cancun Airport, I was unexpectedly directed to a customs inspection table. After thoroughly inspecting my luggage, which included awards for an upcoming TASK Live event I was hosting for my travel agent training program, the customs officers first attempted to tax me on the awards. I explained that the awards were personalized with names, rendering them of no commercial value.

After realizing they could not tax me on the awards, the customs officers shifted their focus to the fact that I had a laptop and an iPad. The officials claimed it was against Mexican law to bring in both electronic devices and that I had exceeded the permitted limit for duty-free items.

Despite my attempts to explain that I was visiting for business purposes, organizing an event to promote Mexico as a destination for travel agents and that neither device was for commercial sale, I was coerced into paying an arbitrary fine of $170. The customs officer, unprofessionally clad in sunglasses and using aggressive language, threatened me with fines up to $1,000 or even arrest when I asked to contact the U.S. Embassy. Fearing for my safety and without understanding the charges against me, I reluctantly paid the fine and was allowed to leave the airport.

The Mexican Government’s Justification

After multiple correspondences with Mexico’s Director General of Customs Operations, I received an official response explaining the legal basis for the fine. According to the letter, the fine was justified under Mexico’s Rule 3.2.3, section I, clause b, which limits passengers to bringing in only one portable computer—laptops, iPads, and similar devices are all classified under this rule. They also referenced Rule 3.2.2, which applies a 19 percent global tax rate on the excess value of goods not covered by the duty-free allowance.

The customs office claimed that since I had both a laptop and an iPad, I exceeded the allowance for personal electronics and was subject to a fine. However, the value of my iPad was grossly inflated, and the fine I paid far exceeded what should have been a nominal charge. According to Mexican law, the tax rate on goods valued under $500 should be no more than 16 percent, meaning my fine should have been around $56, not the $170 I was charged.

Wider Implications for Tourism

This incident raises serious concerns about the future of tourism in Mexico, particularly for travelers who visit the country for business or corporate events. What happens when a large corporate group brings the necessary equipment for incentive meetings or events? Should they expect to be fined or extorted at the airport simply for carrying standard business items like laptops, projectors, or tablets?

Mexico’s tourism industry relies heavily on visitors’ positive experiences. However, stories like mine are becoming alarmingly common. A recent article in Riviera Maya News highlights similar incidents where tourists are “nailed” for arriving with “too many electronics” at Cancun International Airport. Even Forbes has recently covered this troubling trend, warning travelers to prepare to pay hundreds of dollars in fines for carrying multiple devices like laptops and iPads.

For decades, my agency, Elite Travel Management Group, has promoted Mexico as a destination for weddings, incentive meetings, and tourism events. My efforts have brought millions of dollars to the country’s economy. However, if incidents like this continue, individual travelers and large corporations may begin looking elsewhere for their vacations and business events.

A Call for Change

If Mexico’s government needs additional revenue, there are far more transparent ways to achieve this goal—such as implementing a transparent, upfront tourist fee. However, using customs laws to trap and extort visitors at the airport is not the answer. It creates a negative image of the country and discourages tourism, which Mexico heavily depends on.

This isn’t just a personal inconvenience but a potential long-term problem for Mexico’s tourism industry. As word continues to spread about the unpredictable and, at times, aggressive treatment of travelers at its airports, tourists and businesses may start to choose destinations where they feel welcome and safe.
