Mexican Customs Agents Aren’t Scamming Tourists Cancun’s Airport, Import Taxes Are Real

Travelers can be taxed at the airport for bringing two portable computing devices into Mexico

Whether traveling for business or pleasure, most feel the need to remain tethered to the digital world in some capacity. Some travelers are discovering the hard way that Mexican customs agents in Cancun will tax them at the airport for bringing multiple electronic devices into the country. While tourists feel like they are suddenly being extorted, the law has always been on the books but just selectively enforced.

Mexico’s law only allows one portable computing device to be brought into the country tax-free. The levy can be up to 19 percent of the device’s value assessed by the agent. The headaches really begin when you dig into what’s defined as a portable device. Cell phones are in their own separate category, where you’re allowed three. However, tablets aren’t separated, so you can’t take both a MacBook and iPad into Mexico free of charge. This is what happened to Florida resident Tammy Levent. USA Today explained:

When Levent arrived at the airport this time, she had two check-in suitcases and a carry-on with her. Passing through customs, she was flagged to one of the tables where her luggage was examined by an agent. The agent pulled out her iPad and laptop, telling her, “You can’t have both,” she recounted to USA Today. She said she’s always brought these devices with her before, and this was the first time it was an issue.

Levent said her older generation iPad was considered worth much more than it really is by the agent, making her fine higher than she felt was fair. “This was wrong,” she said about her experience.

“At the end of the day you want tourism but you’re driving people away,” Levent said. “You have huge companies like pharmaceutical companies… (bringing bring groups in) and they’re coming with laptops and iPads.”

The rule is intended to prevent people from profiting from reselling merchandise. Agents can tax clothing, footwear, hygiene products and beauty products if you bring in more than what would likely be used during your stay. The custom law also covers a wide variety of technologies essentially dead in 2024. For example, travelers can bring five laser discs, 10 DVDs, and 30 CDs into Mexico tax-free.

I’m not going to argue for or against Mexico’s import laws, but I will state that you should be aware of any country’s rules when you plan on visiting. Don’t be like NASCAR driver Kyle Busch, who was detained at Cancun International Airport for bringing a handgun into the country last year.

Cancun Airport Extortion? A Tourist’s Experience and the Potential Impact on Mexico’s Tourism

As a travel professional and owner of Elite Travel Management Group, with almost 30 years of experience bringing business to Mexico, I never anticipated that my most recent trip to Cancun in June 2024 would leave me questioning the future of tourism in this beautiful country. What began as a routine entry into Mexico turned into a distressing ordeal that left me feeling extorted, frustrated, and deeply concerned about the treatment of tourists.

Upon arriving at Cancun Airport, I was unexpectedly directed to a customs inspection table. After thoroughly inspecting my luggage, which included awards for an upcoming TASK Live event I was hosting for my travel agent training program, the customs officers first attempted to tax me on the awards. I explained that the awards were personalized with names, rendering them of no commercial value.

After realizing they could not tax me on the awards, the customs officers shifted their focus to the fact that I had a laptop and an iPad. The officials claimed it was against Mexican law to bring in both electronic devices and that I had exceeded the permitted limit for duty-free items.

Despite my attempts to explain that I was visiting for business purposes, organizing an event to promote Mexico as a destination for travel agents and that neither device was for commercial sale, I was coerced into paying an arbitrary fine of $170. The customs officer, unprofessionally clad in sunglasses and using aggressive language, threatened me with fines up to $1,000 or even arrest when I asked to contact the U.S. Embassy. Fearing for my safety and without understanding the charges against me, I reluctantly paid the fine and was allowed to leave the airport.

The Mexican Government’s Justification

After multiple correspondences with Mexico’s Director General of Customs Operations, I received an official response explaining the legal basis for the fine. According to the letter, the fine was justified under Mexico’s Rule 3.2.3, section I, clause b, which limits passengers to bringing in only one portable computer—laptops, iPads, and similar devices are all classified under this rule. They also referenced Rule 3.2.2, which applies a 19 percent global tax rate on the excess value of goods not covered by the duty-free allowance.

The customs office claimed that since I had both a laptop and an iPad, I exceeded the allowance for personal electronics and was subject to a fine. However, the value of my iPad was grossly inflated, and the fine I paid far exceeded what should have been a nominal charge. According to Mexican law, the tax rate on goods valued under $500 should be no more than 16 percent, meaning my fine should have been around $56, not the $170 I was charged.

Wider Implications for Tourism

This incident raises serious concerns about the future of tourism in Mexico, particularly for travelers who visit the country for business or corporate events. What happens when a large corporate group brings the necessary equipment for incentive meetings or events? Should they expect to be fined or extorted at the airport simply for carrying standard business items like laptops, projectors, or tablets?

Mexico’s tourism industry relies heavily on visitors’ positive experiences. However, stories like mine are becoming alarmingly common. A recent article in Riviera Maya News highlights similar incidents where tourists are “nailed” for arriving with “too many electronics” at Cancun International Airport. Even Forbes has recently covered this troubling trend, warning travelers to prepare to pay hundreds of dollars in fines for carrying multiple devices like laptops and iPads.

For decades, my agency, Elite Travel Management Group, has promoted Mexico as a destination for weddings, incentive meetings, and tourism events. My efforts have brought millions of dollars to the country’s economy. However, if incidents like this continue, individual travelers and large corporations may begin looking elsewhere for their vacations and business events.

A Call for Change

If Mexico’s government needs additional revenue, there are far more transparent ways to achieve this goal—such as implementing a transparent, upfront tourist fee. However, using customs laws to trap and extort visitors at the airport is not the answer. It creates a negative image of the country and discourages tourism, which Mexico heavily depends on.

This isn’t just a personal inconvenience but a potential long-term problem for Mexico’s tourism industry. As word continues to spread about the unpredictable and, at times, aggressive treatment of travelers at its airports, tourists and businesses may start to choose destinations where they feel welcome and safe.

My approach to this is rooted in my military background, where we always prepared for the worst-case scenarios and ensured that everyone on the team was cross-trained to handle each other’s responsibilities. This way, no matter the situation, we were always ready to respond effectively.

One experience that exemplifies this approach occurred while I was on a trip, and my crew was installing a new sprinkler system at a client’s home. I had spent months preparing for such scenarios by training my supervisor to handle my role in my absence. This involved not just understanding the technical aspects of the job but also the decision-making processes and communication protocols necessary to resolve issues quickly.

While I was away, another utility company accidentally ran over our lines, causing a significant leak in the system. The client was understandably upset and reached out to me directly, even though I was out of the office. Thanks to the preparation I had put in place, I was able to handle the situation seamlessly. I immediately contacted my supervisor, whom I had already instructed to keep his phone accessible for any urgent calls from me. He answered without delay, and I briefed him on the issue.

Because we had planned for this exact scenario, my supervisor and crew were able to fix the problem immediately. I had also pre-arranged overtime compensation for situations like this, ensuring that the crew was motivated and ready to work beyond normal hours if necessary. The problem was resolved quickly, the client was satisfied, and my trip was not disrupted further.

This experience reinforced the importance of proactive planning and communication. By assuming worst-case scenarios and backward planning, I was able to ensure that my business continued to run smoothly, even in my absence. This level of preparedness not only mitigates risks but also builds confidence among clients and within the team, knowing that we can handle emergencies efficiently, no matter where I am.

I will never forget helping a family on a trip to Africa who had an unplanned medical emergency. Before they were scheduled to travel home together, a young woman who works for an NGO in Zambia received a visit from her parents and brother. However, the mother fell during a safari trip and broke her back severely.

There were many obstacles to getting her proper care in a far-off place. Fortunately, their travel insurance covered the cost of sending the mother to a better hospital in Johannesburg via air ambulance. However, while she was receiving treatment, it meant unanticipated changes to the group’s itinerary and delays.

The father and daughter had to deal with extra stress and costs when they had to stay in Africa for weeks longer than anticipated. However, they ignored it all and concentrated on the mother’s health, the most crucial consideration. Their adaptability and ability to go with the flow demonstrated flexibility that has helped many travelers in challenging situations abroad. It was encouraging to see their cooperation and fortitude in a problematic circumstance far from home.

I won’t sugarcoat it: There were moments of frustration, some of which, I must admit, were directed at me. Nevertheless, that’s my job as an Emergency Travel Fixer. I understand that emotions can run high when under a lot of stress. This interaction encapsulates why I am excited to work at Golden Rule Travel.

Encourage a Deep Appreciation For Different Perspectives

Travel experiences, especially with plenty of interaction with the locals, have provided a deep appreciation for different people and perspectives, especially in my nursing profession. 

Two weeks after I graduated from nursing school in 2002, I was in Italy for six weeks, teaching English to Italians and many internationals from Eastern Europe. Wow, what an experience and one that would shape my perspective on internationals overall and a deep respect for internationals here in America. Implement Time-Blocking Method

I’ve been running a business for 15 years, and managing my time, avoiding procrastination, and staying focused has been one of the hardest things to learn. It has only been in the last year that I’ve discovered the annoyingly simple method of time-blocking, and this has revolutionized the way I’ve worked and improved my efficiency massively.

Time-blocking is the simple process of blocking out periods of the day and assigning specific (or thematic) tasks to that block. I created a spreadsheet, with each day of the week broken down into 30-minute slots. Over the first few weeks, I continually reorganized and re-prioritized tasks until I reached a stage where I found the structure was most efficient and effective. I then transferred the schedule to my calendar system with the relevant alert notifications set up to keep me on track. Now, my focus is tightly controlled by this timetable. I know I have to finish those tasks within that block; otherwise, I won’t be able to return to them until another day.

It’s worth mentioning that time-blocking requires discipline and for you to unlearn certain conditions. One of the biggest changes in my productivity and focus lies in how I deal with emails. I’ve always been a champion of Inbox Zero, but since time-blocking, I’ve realized that this was merely a method of procrastination and somewhere to turn to if I felt my focus waning. Clearing my inbox felt like completing an important task, but it just inevitably led to replies in return in an endless, unhelpful cycle.

With time-blocking, I have allowed myself three 30-minute periods a day dedicated to email: one in the morning, the afternoon, and shortly before the end of the day. Working in this way has been freeing and has forced me to focus on the truly important emails and comms during those periods. Keeping the inbox at arm’s length has seen huge growth in all the other areas of my business, including client retention, project quality, and new leads, which I’m sure you can appreciate are crucial to business sustainability and longevity.
